Throughout the 18th century, the city of Buenos Aires and its surrounding countryside experienced an intense demographic and economic growth. However, this era of prosperity at the same time was accompanied by certain social problems. In addition to the legal inequality inherent in the colonial order, a series of processes deepened situations of vulnerability and social marginalization in broad sectors of the population. What mechanisms made it possible for these impoverished groups to ask to defend their rights in the courts? How did poor and illiterate people have access to colonial justice? This article aims to provide some explanatory clues to these questions by studying a specific topic: the free legal aid provided by the “Defensor de pobres” of the city hall to people in need in the context of civil litigation. The normative regulation of the time in this regard will be examined, but also the judicial praxis of the actors, in order to unravel some particularities of the Old Regime law prevailing in the southernmost corner of the Spanish empire in America.
