The challenge of clarifying what constitutes a judicial error or a flawed judicial decision is complex. There are various notions of this phenomenon, each constructed for different legal-professional contexts. Although it may be impossible to identify a unifying element among these notions, it is possible to seek their “central case”. This central case is built by relating the data collected about the phenomenon, the different uses of these notions, and the reasons behind the creation of mechanisms and institutions designed to prevent, sanction, remedy, or correct flawed judicial decisions. The effort to identify this central case yields a set of recurring features that tend to be present in paradigmatic examples. These features, in turn, illuminate the distinction between irregular decisions and those that are merely debatable or subject to reasonable disagreement. Moreover, this analytical framework facilitates the identification of specific components within judicial decisions that are most susceptible to such anomalies. Finally, it also enables a systematic presentation of the most prevalent judicial irregularities, in order to facilitate the work of those seeking to prevent, avoid, or remedy flawed judicial decisions.
