This paper presents a critical analysis of immigration policies in force in Paraguay: Law 978/96 and the most recent, No. 3958. It is expected to detail the advances and setbacks in immigration law that occurred during Fernando Lugo’s administration, who (especially in the campaign) positioned "emigrants" as central political actors, whom the state should provide the conditions of return. It is concluded that there was not changes into the paradigm in immigration policy. The core of the concept of migration is still intact and also, within the law and the modifications introduced by the new rules, the idea of return is associated with matrix production in Paraguay.
