In Argentina, criminal lawyers often analyze offences from a positivistic or formalistic point of view. However, as this paper shows, Argentinean criminal lawyers, like Ricardo Núñez and Sebastián Soler, could not have established the elements of certain offences -particularly, the offence of fraud- using the dogmatic methodology (criminal law theory) advocated by them exclusively, that is: finalism and functionalism. In order to exemplify this thesis, it will be briefly analyzed what strictly rises from the Argentinean Criminal Law (i.e., legal formulations that characterize the crime of fraud in Argentina) and what doctrine and jurisprudence have interpreted as regards this offence in Argentina. Finally, a comparison between Argentinean law and both Spanish and German criminal law will be offered.
