The aim of this paper is to analyze the lack of legal and jurisprudential enforcement of indigenous communal property and its mitigating mechanisms (suspension of evictions) in Santiago del Estero (Argentina). Through qualitative content analysis of a provincial court ruling and other sources, such as legislation, specialized bibliography, and statistical information, we seek to understand the role of the State (across its various levels and branches) in enforcing this collective right. We note that the State, in its legislative branch, is negligent in defining this type of property, relying instead on emergency laws that are not adopted at the provincial level. The executive branch fails to implement these laws, and the judiciary perpetuates a hyper-formalist culture that disregards constitutional and conventional principles when adjudicating disputes involving indigenous territory. We conclude that this prevents the full realization of this legal framework and, consequently, the material recognition of ancestral rights related to access, control, and permanence on the land.
