Narrar el Estado | el Estado narrador: instituir con la letra y la ley

Abstract

El presente trabajo tiene como objetivo analizar el papel constitutivo de las narrativas jurídicas y literarias en el proceso de formación del Estado argentino. A partir delos aportes metodológicos ofrecidos por los estudios de "derecho y literatura:, el texto propone indagar cómo se han utilizado los recursos ficcionales para instituir perspectivas ideológicas específicas. En este sentido, se pueden identificar numerosas interrelaciones discursivas entre textos literarios y jurídicos, por momentos sin poder establecer de manera precisa los límites entre uno y otro espacio. La letra no solo interviene desde una perspectiva estética, sino que también instituye una narrativa específica en la organización del Estado.Al mismo tiempo, este gran aparato estatal hará uso de los relatos para desplegar su estructura política y su intervención en el imaginario social.

O presente trabalho tem como objetivo analisar o papel constitutivo das narrativas jurídicas e literárias no processo de formação do Estado argentino. A partir das contribuições metodológicas oferecidas pelos estudos de ‘direito e literatura’, o texto propõe investigar como os recursos ficcionais foram utilizados para instituir perspectivas ideológicas específicas. Nesse sentido, podem ser identificadas inúmeras inter-relações discursivas entre textos literários e jurídicos, por vezes sem conseguir estabelecer com precisão os limites entre um e outro espaço. A letra não apenas intervém de uma perspectiva estética, mas também institui uma narrativa específica na organização do Estado. Ao mesmo tempo, esse grande aparato estatal fará uso dos relatos para desplegar sua estrutura política e sua intervenção no imaginário social.

The present work aims to analyze the constitutive role of legal and literary narratives in the process of the formation of the Argentine State. Based on the methodological contributions offered by the studies of ‘law and literature,’ the text proposes to explore how fictional resources have been used to establish specific ideological perspectives. In this sense, numerous discursive interrelations can be identified between literary and legal texts, at times without being able to precisely establish the boundaries between one and the other space. The text not only intervenes from an aesthetic perspective, but also institutes a specific narrative in the organization of the State. At the same time, this big state apparatus will make use of these narratives to deploy its political structure and its intervention in the social imagination.
