With his thesis on the identity of origin between the rule of law and popular sovereignty, Habermas seeks to place his theoretical approach to democratic politics between the liberal and republican traditions. This paper analyzes this position, taking into account the theoretical and practical performance (in this conceptual framework) of the principle of popular sovereignty. The thesis to be defended maintains that, in spite of such a pretension, the explanation of said performance raises doubts about the referred theoretical place in which the philosopher places his conception of deliberative politics.
