Aportes iusfilosóficos desde el vínculo "derecho y literatura" en Argentina: Estudios epistemológicos del saber jurídico desde la obra literaria de Jorge Luis Borges

Abstract

El presente trabajo se propone indagar sobre determinadas instancias epistemológicas del saber jurídico, a partir de las propuestas conceptuales y metodológicas que aportan los estudios entre derecho y literatura. Los vínculos entre los espacios del derecho y los textos literarios, ofrecen un amplio espectro de investigaciones. A partir de herramientas y materiales teóricos que aporta la obra literaria del escritor argentino Jorge Luis Borges, el análisis se centrará en torno a las posibles formas de construcción y despliegue de las estructuras que formalizan la disciplina jurídica. Los insumos y consideraciones conceptuales que ofrece la literatura borgeana, permitirán realizar un análisis iusfilosófico de determinados tópicos y categorías pertenecientes al espacio de la teoría jurídica en general y específicamente, a la constitución epistemológica del saber jurídico.The present article aims to investigate certain epistemological instances of legal knowledge, based on the conceptual and methodological proposals provided by studies between law and literature. The relationships links between the areas of law and literary texts offer a wide spectrum of studies. Based on theoretical tools and materials provided by the literary work of the Argentine writer Jorge Luis Borges, the analysis will focus on the possible forms of construction and deployment of the structures that formalize the legal discipline. The inputs and conceptual considerations offered by the Borgean literature, will allow us to carry out an iusphilosophical analysis of certain topics and categories belonging to the space of legal theory in general and specifically, to the epistemological constitution of legal knowledge.
