The domestic work is a labor that has historically been performed by women with enormous social and economic deprivations. In Argentina, until 2013, the situation of these workers was marked by a current decree-law extremely restrictive in terms of rights. Through this article, and in order to show the recent legal changes carried out by the Argentinian state, we will try to briefly characterize the phenomenon of domestic work in this country and provide a comparative analysis between the old laws, which considered this group of women “servants”, and the current law, which considers them “workers”. For that, we will make a socio-legal analysis to addressed the important improvements registered in specific key themes (work dependence, the extension of working hours, break hours, maternity leave, occupational risk prevention and sick leave, among others) and, at the same time, we will discuss other pending aspects which must be addressed in order to ensure the access to full employment rights.
