Starting in December 2023, with Javier Milei (La Libertad Avanza, radical right-wing party) taking office as president, there was a significant change in the treatment of social protest, which was redefined as a crime. The argument advanced in this article is that the criminalization of protest constitutes a political operation by the government to facilitate the implementation of economic adjustments that deepen social inequalities and, above all, to neutralize the action of social movements and their role as promoters of democracy. In methodological terms, the article follows a qualitative perspective that combines legal analysis, documentary evidence, and a detailed description of the situation, which has been examined through a corpus consisting of government regulations, statements by national government officials on social media, and materials produced by social organizations, trade unions, and human rights organizations. It concludes that Milei’s government has required the establishment of a state of emergency to legitimize the criminalization, restriction, and repression of street demonstrations, generating a process of social demobilization and a reduction in pluralism in society.
