During recent decades, a greater interest in diversity has been progressively established as well as what it entails, which has set numerous investigations in Education while the historical and social changes have affected the student population, appearing new curricular and pedagogical challenges, among others. The advancement of the Right to Education promoted some help by public policies to further realization of curricular regulations in educational tracks that had traditionally been marginal fields, servicing at-risk minorities, like that of hospital education. In this way, we can identify how new international discussions and acts (some reflected in regulations and documents of diverse nature) succeeded in amending certain aspects and dimensions that allow the progress in the analysis of the features of Education as a social right and having collective impact. In countries like Argentina and Spain, after profuse educational reforms that modified, among others, key issues such as types of government and the academic structure, it is pertinent to investigate the scope of the Right to Education in childhood and young people in particular contexts of diversity care. In this work, we analyze the scope of the Right to Education in one of the educational tracks of great recent consideration: hospital schools and classrooms. Through this analysis of various international law instruments related to human rights, we aim to show and discuss the scope and features from the development of services promoted in this track in selected countries. We present the topic and its regulation in every national case as well as educational projects advocated, in order to contemplate and assess their mediate and future unfoldings
