The present text suggests an approach to some of the main theoretical discussions at the heart of Marxist tradition about punishment as a social phenomenon. Due to the absence of a general theory about the State as developed by Marx, this study concentrates on research that analyzes the “superstructure level,” whose significance is associated with the capacity to reveal the importance of non-economics relations in supporting economic power. In the specific case of punishment, it is possible to recognize at least two general stances on punishment. On one hand, there are studies that link punishment directly with the general restrictions of labor markets and, on the other hand, proposals that insist on its ideological function in charge of legitimization symbols and the justification for class predominance.
