Entre la autonomía y el auto-respeto: Hacia una explicación liberal del valor moral del consentimiento en el contrato de donación

Abstract

¿En qué circunstancias requerimos el consentimiento ajeno para actuar justificadamente? De acuerdo a una larga tradición, el consentimiento sería necesario fundamentalmente cuando el acto que vamos a realizar corre el riesgo de afectar negativamente el interés de otra persona, mas no cuando las intenciones que nos impulsan poseen un carácter prima facie benéfico. Pero si ese es típicamente el caso, ¿por qué nuestros sistemas de derecho contractual exigen que las donaciones sean consentidas, siendo que una gran parte de ellas simplemente procuran beneficiar a sus destinatarios/as? Para responder este interrogante, el presente trabajo propone transitar un trayecto lógico compuesto de dos etapas: una primera etapa, en donde buscará precisarse por qué es moralmente importante que las donaciones sean consentidas; y una segunda etapa, en donde buscará comprenderse por qué no es menos importante que lo sean por vía contractual. Detrás de ambas etapas subyace una misma hipótesis explicativa, referida al valor liberal de la autonomía humana y del auto-respeto implicado en la misma, dos nociones que aquí se entenderán en un sentido estrictamente rawlsiano.

Under what circumstances are we required to obtain other people’s consent in order to act justifiably? A long-standing tradition has it that consent must be mainly in place when the act to be carried out has the potential of hindering someone’s interests, but not necessarily when its most seeming intention is prima facie beneficial. However, an intriguing double question arises: Why is it that our contract-law systems subject donations to the same consensual condition? Aren’t they supposed to be carried out for the sole benefit of their own recipients? To address this double question, the present paper proposes a logical two-step approach. In the first stage, it seeks to specify why it is morally important that donations become consensual. In the second stage, it explores why it no less crucial that they become contract-based. The common hypothesis underpinning both argumentative stages is that most of the justificatory work to be done in this area rests on two fundamental pillars: the liberal value of autonomy and the basic good of self-respect implied by it, two notions that will be here understood in a strictly Rawlsian sense.
