This chapter proposes an analysis on the development and innovation in the field of nanotechnology and nanomedicine (focusing on the pharmaceutical area) in our country, exploring both the aspects related to basic and applied research as well as the patents concerning the subject. Scientific capabilities are weighted by examining the areas involved and their application. Next, the situation of the pharmaceutical sector in terms of innovation at a national level is explored and, finally, the intellectual property in nanotechnology and the degree of impact on the requested patents in the world. Regarding the scientific capacities in nanomedicine, it can be inferred that the development of drug release systems is one of the main topics addressed by the Research and Development (R&D) groups, such as metallic, polymeric and lipidic nanoparticles stand out. In relation to the study of the pharmaceutical sector, it was detected innovation capacity constraints at national level and a clear need for a more effective relationship between R&D groups and the business sector. As for the challenges posed by intellectual property in this emerging discipline, it should be noted that new paradigms and formats for inventions in nanotechnology had to be established, ranging from product labeling to the basic conditions for the invention can be patented. In this sense, an analysis of different cases of determination of inventive step leads to rethink how to raise future patent applications. In this line, it was observed that the degree of applications in nanotechnology was high worldwide between 2003 and 2012, with a marked decrease in recent years. Although the compilation and adequate classification of the information presents an appreciable complexity, this chapter aims to make a substantial contribution to the determination of the innovation situation in nanotechnology and nanomedicine.
