This Article analyzes the issue of judicial review from the point of view of the concept of rational discourse of Habermas and Apel. This is a subject which is always in tension with democracy, because it is argued that the democratic process has a legitimacy to decide that do not have the judges to intervene in political matters. From the habermasina’s perspective it is possible to justify the compatibility between both points of view on his theory of the identity of origin between the rule of law and popular sovereignty. Furthermore, this work also explores the rational justification of this joint (articulation) between the law and the democracy from the discourse ethics and its deliberative processes of rational foundation of moral norms, which is distinguished by its essentially reconstructive budgets of argumentative discourse.
