The importance of the right to self-determination of peoples as a tool to respect Human Rights is directly proportional to the vagueness with which it has been formulated. As a consequence, it has been subject to manipulation by both States and political movements to use it as an argumentative tool functional to their particular interests and not as an instrument of respect for Human Rights. In this work, through the exposition of some historical examples and jurisprudential rulings, we will try to expose how the principle of self-determination of peoples can be used as the foundation of separatist movements and contribute to the territorial conflict between States. We will also propose to account for the noble, but complex, consensus solution proposal.
