In this work, I propose to analyze and understand the juridification of the right to land and territory, focusing on the efforts of peasant movements in Argentina to reduce forms of exclusion from the right to access and/or retain land. Methodologically, this work is based on the compilation of secondary sources concerning laws and projects promoted by peasant organizations between 1990 and 2023. From these sources, I argue that the development of peasant political logic has led to a process of increasing complexity in the juridification of the peasant question, which is now based not only on the right to land but also on the right to territory. This distinction reveals a shift from a distributive legal discourse, in the case of land rights, to one where the pursuit of recognition of human rights implies the emergence of a pluralistic legal framework.
