¿Mommsen contra sí mismo?: Una lectura de las ambivalencias de Römisches Staatsrecht

Abstract

La obra de Mommsen ha sido usualmente interpretada a partir de su énfasis en las instituciones romanas, pero atendiendo escasamente sus cambios y su vínculo con luchas y procesos sociales. El artículo analiza distintas temáticas abordadas en el Römisches Staatsrecht, reconociendo el carácter contradictorio con el que Mommsen aborda al derecho romano, aun cuando busca conservar su sistematicidad. Se sostiene que el texto puede ser interpretado como una recreación de operaciones jurídicas y de cómo ellas buscan tramitar las tensiones con aquello no regulado.Mommsen’s work interpretation has usually focus on his emphasis on roman institutions, but lacking attention to changes and their relation to struggle and social processes. The article analyses different topics presented in the Römisches Staatsrecht recognizing the contradictory character of the Roman law presented by Mommsen, even under the preservation of its systematicity. We argue that the text may be studied in terms of the recreation of legal operations and how deals with the tensions of what has not been regulated.
