Much has been discussed about the effectiveness of social rights. I think that in these days this discussion is resolved. However, the enforcement of social rights remains. In this paper, I argue that the idea of social rights can be linked to different conceptions of equality: equality as non-discrimination and equality as non-submission. The latter implies that it is not enough to guarantee those rights; their full possession must be guaranteed according to the particular situation of each group. However, in many cases there are no policies or there are inadequate to guarantee those rights. Thus, situations of “no possession” or “insufficient possession” of social rights are claimed before the judiciary. The judiciary faces many problems when deciding a case as problem of individual or structural inequality.
