This paper aims to explore and discuss the emerging paradigms of the right to the city, fair habitat and the principle of equal protection under a structural perspective, around the situation and social conditions that characterizes vulnerable neighborhoods or slums in Latin America and Argentina. We argue that these new rights approaches, fruits of social mobilization and participation, attempt in a multidimensional manner to account for the complex social reality that affects these neighborhoods and related phenomena such as socio-spatial segregation and social inequality in all Latin American cities. Thus, the traditional analytical frameworks about violations on social rights such as fair housing, access to health or education, among others, are weighted in an aggregative and joint way to other more complex and specific social dimensions that are part of the dynamics of the city. These urban and legal approaches bring novel rules and principles that are slowly permeating the implementation of regulations and public policies in the cities of the region and our country.
