La vigencia post mortem auctoris de los Derechos de Autor y su transmisión mortis causae

Abstract

El artículo ensaya soluciones alternativas a la actual vigencia post mortem del derecho de autor.Primero, se repasan sus fundamentos históricos. Luego, se los analizan críticamente a la luz delderecho al acceso a la cultura y de la protección del autor que consagran los tratados de derechoshumanos. Por último, se proponen cambios con miras a armonizar los intereses de los titularesde derechos de autor con los derechos culturales de la comunidad. Concretamente, se proponela reducción del plazo de vigencia post mortem, y por otra parte, la mutación en la naturalezajurídica del derecho una vez que ocurre el fallecimiento del autor, el que pasaría a convertirse enun derecho de remuneración.This paper explores alternative solutions to the present duration of post mortem copyright. First, its historical foundations are reviewed and then critically analyzed under the right of access to Culture and authorship protection consecrated by human rights treaties. Finally, we propose changes in order to harmonize copyright owners’ interests with the community’s right to Culture. Specifically, we propose reducing the term of post mortem copyright duration as well as mutating the juridical nature of the right so it would become a right to remuneration at the author’s death.
