This work aims to demonstrate that Argentina’s constitutional process was deeply influenced by the collective memory of democratic breakdowns and the severe human rights violations committed during the last dictatorship. The adoption of a clause for the defense of democracy and, most notably, the incorporation of human rights treaties with constitutional hierarchy, were its main milestones. Two factors made this possible: the opportunity to address specific topics within the constraints set by Law 24.309, and a consensus shaped by the personal experiences and knowledge of a generation within the convention. This research relies on discursive analysis of the constituent assembly debates to illustrate how the relationship between constitutional reform and memory permeated all sessions, especially in four key moments.
