Cuando los derechos no son para todos: El caso del voto de los extranjeros

Abstract

En el presente trabajo realizamos una descripción de las limitaciones que tienen los extranjeros para ejercer el derecho de sufragio. En particular detallamos, respecto de los Estados europeos, latinoamericanos y las provincias argentinas, los alcances del derecho a elegir cargos políticos que tienen quienes no poseen la nacionalidad del Estado en que residen. Asimismo, y desde un plano más conceptual, inscribimos el caso del derecho a elegir de los extranjeros, dentro del problemático solapamiento entre derechos ciudadanos y derechos del hombre, diagnosticado por Hannah Arendt y Giorgio Agamben.In this paper we make a description of the limitations of foreigners to exercise the right to voteParticularly we detail, respect of European States, Latin American and Argentinean provinces, the scope of the right to elect that have who are not nationals of the State in which they reside. Also, in a more conceptual approach, we inscribe the case of the right to vote of foreigners, within the problematic overlap between civil rights and human rights, diagnosed by Hannah Arendt and Giorgio Agamben.
