AKer the triumph obtained in the Battle of Pavón in 1861, the focus of federal rebellion converged in the western región of the country. In this context, Domingo Faustino Sarmiento, exiled in chile at the time, came back to Argentina to exercise the governorship of the province of San Juan and assume the “civilizational crusade” started in Buenos Aires. Mis period was characterized by the reinforcement of the tools for state control and the institutional modernization tending to eliminate the rebellious collective practices against the Liberal State; not just from the military action but also, making use of justice as a building device of sense in favor of the reinforcement of the sentence and the dislocation of the crime. Me next article aims to be the Nrst approach to the thoughts of Domingo Faustino Sarmiento about punishment, specially at the commission of crimes in dissidence with the new established order, during the period he exercised as governor of the province of San Juan (1862-1864). In this way, we hold that the liberal speech about the civilized punishment, incarnate in Domingo F. Sarmiento was wielded more like an enunciation for the construction of representations about the State, and less like an eOective practice and a change towards a new punitive paradigm
