In both Argentina and Spain, the abusive and discretionary use of conscientious objection constitutes one of the main impediments to equal and democratic access to legal and safe abortion services. The historical persistence of problems such as these generates and deepens structural and territorial inequalities, especially among women and pregnant people who lack sufficient economic resources to travel to urban health centers or access the private health system. This brief essay, the result of a Carolina Foundation Short Postdoctoral Stay conducted in 2022 at the University of Barcelona (Spain), seeks to reflect parallels between the present and current obstacles in both countries regarding the scenarios and processes of applicability of laws on voluntary termination of pregnancy. In a transnational context marked by the advancement of policies and legislation regarding sexual, reproductive, and non‐reproductive health, the research focused on investigating reactive behaviors in the face of these agendas, reflected in the interposition of obstacles to access to abortion within health institutions and exacerbated by the conservatism of medical culture.
