The regulation of Tort Liability in Private International Law in Argentina dates from 2015. There has been a shift towards the law of the place where the damage occurs or manifests itself, away from the place where the event has occurred. The damage is then considered as the central axis, with greater proximity and predictability for the victim. International jurisdiction is distributed in concurrent forums that exclude the forum of the actor considered exorbitant. The tort system acts as an exclusion of provisions of anticipated cases. When the proximity and fairness of the case require it, the application of the exception clause could be considered. There is a lack of regulations regarding transboundary environmental damage.
