O crime não existe, a notícia tampouco: seletividade penal e noticiabilidade no Brasil

Abstract

Este trabalho pretende refletir sobre a seletividade do sistema penal, envolvendo uma análise sobre as condutas selecionadas por seus agentes, mas também os fatos escolhidos pelas mídias para se transformarem em matérias jornalísticas. Considerando o pensamento de autores críticos da criminologia e do direito penal em relação com teóricos da comunicação, dialogamos com alguns conceitos de notícia e os critérios de noticiabilidade, para compreender as relações entre mídia e controle da criminalidade, sobretudo no momento em que se opta por noticiar um comportamento considerado criminoso ou as estatísticas da violência urbana.This paper intends to reflect on the selectivity of the penal system, involving an analysis of the behaviors selected by its agents, but also the facts chosen by the media to become news articles. Considering the contribution of critical authors of criminology and criminal law in relation to communication theorists, we dialogue with some concepts of newsmaking and the criteria of newsworthiness, in order to understand the relationship between media and crime control, especially when it comes to reporting behavior considered criminal or statistics on urban violence.
