This paper synthesizes the main philosophical arguments regarding the rights of non-human animals, discussing their status as sentient beings, worthy individuals, members of society, moral subjects, and legal subjects. Reviewing the main ethical currents, i.e., utilitarian, kantian, contractualist and the capabilities approach, these philosophical perspectives and their relevance in the legal context are examined. Subsequently, we conducted a study of Argentine jurisprudence related to cases of animal abuse found online in the site of Sistema Argentino de Información Jurídica (Argentine Legal Information System), aiming to identify the presence and impact of such arguments in judicial decisions. This analysis allows us to understand how ethical and moral foundations can clarify and enrich the argumentation in the legal field, thus contributing to a higher quality of justice in the protection and recognition of animal rights.
