This paper focuses on the early critical reading of Cesare Lombroso’s work by the Argentine jurist and diplomat Luis María Drago in Los hombres de presa (1888). It addresses both Drago’s distancing from the biological determinism implicit in L’uomo delinquente and his objections to the Eurocentrism present in Lombroso’s view of “primitive” peoples. This article analyzes how Drago relies —among other elements— on archaeological Americanism (then an emergent discourse of continental self-affirmation, supported by the prestige of the “great” pre-Hispanic civilizations) to —subtly— question several principles of that theoretical model. This aligns with the author’s broader questioning of European imperialism within the framework of the “Drago Doctrine”. This moderate distancing (which José Ingenieros would later radicalize) is also considered in dialogue with Drago’s conservative conception of the female subject. Thus, this work suggests that, with variations, the same paternalism was exercised to protect criminals, indigenous peoples, and women, also guiding the call for United States intervention as a protector of the American continent.
