The criminal trial initiated in 2005 for the Rincón Bomba massacre—Formosa National Territory, 1947—marked a groundbreaking moment in Argentina, representing the nation's first effective prosecution of an indigenous massacre. In 2022, another landmark ruling emerged, with the first Argentine judgment from a truth trial classifying a 1924 massacre committed by the Argentine State in Chaco National Territory as a crime against humanity, falling under the broader framework of genocide against indigenous peoples. This article delves into the transformations in the Argentine criminal justice system's approach to addressing state repression from 1985 to the present day. It particularly examines the extent to which the criminal judicial treatment of crimes committed during the last Argentine civil-military dictatorship (1976-1983) paved the way for the initiation of other judicial processes addressing state repression throughout the 20th century. Employing a qualitative approach of reviewing and analyzing judicial and journalistic documentary sources, the article explores the various stages that the judicialization processes of these crimes have undergone, focusing on paradigmatic cases selected for their unique significance.
