Sujetos de derecho no tradicionales: Debates sobre el estatus de animales y ríos en la casuística argentina

Abstract

El objetivo de este artículo es describir cómo en Argentina se han suscitado casos en los últimos años que plantean la posibilidad de reconocer el carácter de sujetos de derechos a entes que tradicionalmente quedan fuera de dicha categoría como han sido animales y ríos y qué ha ocurrido en las decisiones judiciales respectivas ya que ello aporta a los debates y las reflexiones sobre cómo regulan los ordenamientos jurídicos las relaciones jurídicas. Para ello se presentan cuatro casos (tres de animales y uno de un río) y se consideran los debates similares a nivel regional.The aim of this paper is to describe cases in Argentina in the last decade that have raised the debate about recognizing the character of subjects of rights to entities that traditionally are outside this category, such as animals and rivers, and what has happened in the respective judgments, as this contributes to the debates and reflections on how legal systems regulate legal relationships. To this end, four cases are presented (three of animals and one of a river) and similar debates at the regional level are considered.
