Conflicto, valores y derechos humanos

Abstract

El conflicto de valores es un problema de los filósofos morales. Específicamente, en primer lugar, porque no hay acuerdo sobre qué es un conflicto y, en segundo lugar, tampoco queda claro cómo comparar los valores en cuestión. El objeto del trabajo es precisar cómo es el conflicto entre los valores y delimitar qué significa comparar entre ellos. En el ámbito jurídico, el conflicto entre los derechos humanos tiene también ciertas dificultades, bien porque no se sabe cuál derecho humano prevalece en una disputa o bien porque no se precisa cuál es el método apropiado para resolver entre ellos. Si se entendiera a los derechos humanos como valores, entonces, se podrían tener mejores herramientas analíticas para aclarar la cuestión. En el caso del conflicto entre derechos humanos, se podría comparar entre ellos y, eventualmente, resolver.The conflict of values is a problem of moral philosophers. If human rights are understood as values, then there could be better analytical tools to clarify the issue.
