The conclusion of executive agreements is a generalized feature in the legal relationship of the States into the international system. In some cases, the conclusion of treaties without the participation of the legislative authority is carried out against the constitutional norms. In other cases, however, this possibility is regulated in the constitutional texts. This paper describes the operation of the designs called 'positive' or 'negative' list, which serve to determine the specific situation where the parliamentary intervention must proceed in the treaty-making mechanism. For this purpose, the paper examines some legislation that represents each system.
