The study intends to analyze the judicialization of the right to food in Argentina by specifically examining the responses by the higher courts of the 23 provinces and the Autonomous City of Buenos Aires (Spanish acronym: CABA). It aims to identify the type of right to food protection claims addressed by these courts and to characterize their responses in light of their grounds, interpretive frameworks and applied remedies. The study employs various techniques for legal and case law analysis, including a survey of judicial decisions, regulations, bibliography and other relevant evidence, in order to undertake a qualitative analysis on the rulings. The 2002-2023 period is adopted in light of the declaration of food emergency by Executive Decree No. 108 (January 15, 2002). The geographical scope includes higher courts of all Argentine provinces and CABA. Our preliminary conclusions highlight the scarce judicialization of the right to food in spite of the continuing food insecurity situation across the selected period under study, and the restrictive constructions of the right to food in the surveyed case law.
