The present article focuses on the systematized children appropriation by the Argentinean Armed Forces during the last military dictatorship (1976-1983). The main purpose is to analyze the concept of biological identity associated to restitution claims from a philosophical approach, in order to criticize the ethical and political tensions related to the production/formation of subjectivities and identities, violated in this particular case. The contributions of Paul Ricoeur about the distinction between sameness and ipseity and the elaborations of Judith Butler related to the subjection/subjectification processes, allow us to reinforce the arguments about the performative character of identity for the purpose to think about ethical and political conditions of the right to identity.
