Un estudio sobre el caso Lava Jato (2014-2022) para una conceptualización marxista del lawfare

Abstract

El objeto del artículo consiste en el análisis de las condiciones de surgimiento del fenómeno político conocido como ´lawfare´. La investigación propone elaborar una conceptualización del lawfare que trascienda la mera descripción del fenómeno y muestre los motivos y condiciones históricas de su génesis. El estudio consta de dos partes (además del estado del arte): primero, una elaboración teórica de categorías y conceptos de la tradición marxista, cuyo fin es esbozar los momentos socio-históricos decisivos del contexto de aparición del lawfare. En segundo lugar, un análisis del caso de lawfare conocido como ´Lava Jato’, y dentro de aquél, enfocándose en el las implicaciones de Odebrecht —especialmente las condiciones sociopolíticas del surgimiento de este caso de lawfare— en tanto caso típico a partir de cuyo estudio se propone un sistema de definiciones para conceptualizar el lawfare en tanto momento político del desarrollo de la última metamorfosis del sistema mundial del capital.The aim of the article is to analyze the conditions under which the political phenomenon known as “lawfare” emerges. The research aims to develop a conceptualization of lawfare that goes beyond the mere description of the phenomenon and instead reveals the motives and historical conditions of its genesis. The study consists of two sections (in addition to the state of the art): first, a theoretical elaboration of categories and concepts from the Marxist tradition, with the aim of outlining the decisive socio-historical moments of the context in which lawfare is produced. Secondly, an analysis of the lawfare case known as “Lava Jato”, focusing on the implications of Odebrecht —especially the socio-political conditions of the emergence of this lawfare case— as a typical case, from which analysis a system of definitions is proposed to conceptualize lawfare as a political moment in the development of the latest metamorphosis of the global capitalist system.
