El derecho de acceso a la información pública en el marco normativo argentino. Implicancias en el Derecho Ambiental

Abstract

El acceso a la información pública constituye un derecho fundamental que el Estado tiene la obligación de garantizar a todos los ciudadanos, y es un elemento esencial del sistema republicano de gobierno. Por tal razón, en el presente trabajo comenzaremos realizando una introducción y la presentación de la metodología utilizada, para luego analizar la recepción de este derecho en nuestro ordenamiento jurídico, haciendo hincapié en el área del Derecho Ambiental en los diferentes ámbitos: internacional, nacional, de la Provincia y de la Ciudad Autónoma de Buenos Aires, para concluir con la exposición de una serie de consideraciones finales. De esta forma podremos vislumbrar globalmente el estado del desarrollo normativo en Argentina, y prever posibles aportes para su inminente evolución en un futuro próximo.Public information access is a fundamental right which should be guaranteed to all citizens by the State, and it is an essential element of the republican system of government. In this sense, this paper we will begin making an introduction and the presentation of the methodology, and then analyze this right´s reception in our legal system, focusing on the Environmental Law in the different areas: international, national, Buenos Aires Province and City, and to conclude with the exposition of final considerations. In this way we can globally envisage the legal development state in Argentina, and anticipate inputs for its imminent evolution in the near future.
