La democracia, el derecho y el capitalismo

Abstract

The phenomenon of the «new far right» posits once again the question on the nature of occidental democratic systems: are they emancipatory or constitutively oppressive? On the one hand, we examine Márcio Naves’ treatment of the problem of law in Marxism, which shows that law is a specifi cally capitalist phenomenon, essential for the reproduction of its relations of production. Consequently, emancipatory politics should be carried out against law. On the other hand, we examine the historical link between the democratic republic and the invention of the school in France: the French will be students before being citizens and voters. This case illustrates that the relationship between disciplinary practices and legal forms is not reduced itself to the moment of the emergence of the system, but that it takes the form of a series of permanent confrontations with a strategic direction. We conclude by stressing the strategic importance of knowing the social conditions of existence of occidental democratic institutions, by examining some aspects of the concept of class dictatorship.
