Traditionally, the theory of deliberative democracy is considered to be a theory “with German roots” based on the works of the German philosopher Jürgen Habermas. This paper discusses this assertion by pointing out that the contributions of the Argentine philosopher Carlos S. Nino also constitute an equally original contribution to the definition of this theoretical conception of democracy. To support this thesis, both theoretical proposals are analyzed, explaining their philosophical foundations and complementarity (in terms of both conceptual similarities and evident differences) with regard to the contributions that can be made from this theoretical framework for the improvement of the democratic quality of the rule of law. The idea is to contribute to the recognition of Nino’s proposal in the philosophical-political framework of deliberative democracy.
