Sobre la igualdad en la concepción del matrimonio como institución en Kant

Abstract

En el presente trabajo se aborda críticamente la concepción de igualdad en la institución del matrimonio en Kant. Argumentaré que dicha igualdad no se sostiene si consideramos al sexismo y a la homofobia en los que incurre Kant en sus escritos jurídicos, éticos y antropológicos. En cambio, propondré repensar la institución del matrimonio al retomar, por un lado, las críticas al sexismo y la homofobia en el pensamiento kantiano, y por otro lado, al considerar la idea del reconocimiento ético y jurídico en su pensamiento maduro.This paper critically addresses Kant’s conception of equality in the institution of marriage. I will argue that such equality does not hold if we consider the sexism and homophobia that Kant incurs in his juridical, ethical and anthropological writings. Instead, I will propose to rethink the institution of marriage by taking up, on the one hand, the criticisms of sexism and homophobia in Kantian thought, and on the other hand, by considering the idea of ethical and juridical recognition in his mature thought.
