La responsabilidad penal de miembros del Poder Judicial durante la última dictadura militar en Argentina (1976-1983): aproximaciones a la construcción de memoria desde sentencias judiciales

Abstract

En el presente trabajo propongo un análisis en torno a la responsabilidad penal de miembros del Poder Judicial en la comisión de delitos de lesa humanidad durante la última dictadura militar en Argentina. Para ello emprenderé, a partir de una metodología de índole cualitativa, una indagación de sentencias judiciales en donde se condenó a magistrados y funcionarios judiciales por los crímenes cometidos durante los años de terrorismo de Estado. En este sentido, el objetivo de este trabajo consiste, en primer lugar, en analizar las distintas maneras en que jueces, fiscales y abogados formaron parte del plan sistemático de exterminio y, en segundo lugar, interesa indagar cómo interpretaron los jueces de los distintos tribunales estas diversas maneras de participación delictiva. Este objetivo me permitirá comenzar a comprender las implicaciones, en términos de memoria social, del juzgamiento y condena de los delitos cometidos por civiles bajo la figura jurídica de delitos de lesa humanidad. De esta manera, concluiré que el Poder Judicial, a partir de sus sentencias, posee la capacidad de producir interpretaciones acerca del pasado reciente con carácter de verdad jurídica que definen cuál es la manera legítima de recordar. Así, sostendré que las sentencias judiciales analizadas en este trabajo constituyeron la presentación pública de una memoria construida desde el Poder Judicial que señaló que magistrados y funcionarios judiciales se volvieron parte central para el funcionamiento y mantenimiento del aparato represivo en tanto brindaron una garantía de impunidad.

In this paper I propose an analysis of the criminal responsibility of members of the judiciary in the commission of crimes against humanity during the last military dictatorship in Argentina. To do this end, usigng a qualitative methodology– I undertake an investigation into court rulings in which judges and judicial officials were convicted for crimes committed during the years of state terrorism. The objective of this paper is, firstly, to analyze the different ways in which judges, prosecutors and lawyers were part of the systematic plan of extermination and, secondly, to investigate how the judges of the different courts interpreted those different ways of criminal participation. This objective will allow to begin to understand the implications, in terms of social memory, of the judgment and conviction of crimes committed by civilians under the legal figure of crimes against humanity. In this way, I conclude that the Judiciary, based on its rulings, has the capacity to produce interpretations of the recent past with the character of legal truth that define the legitimate way of remembering. Thus, I maintain that the judicial rulings analyzed in this work constituted the public presentation of a memory constructed by the Judiciary that indicates that magistrates and judicial officials became a central part of the operation and maintenance of the repressive apparatus insofar as they provided a guarantee of impunity and therefore deserve to be condemned.
