Abstract

Este artículo trata de la interpretación constitucional a partir del significado de la Constitución y sobre quién debe ser responsable de su interpretación. Aunque algunos creen que la interpretación constitucional ideal es la que resulta de un proceso colectivo, que abarca la cuestión institucional de quién tendría la autoridad para hacer tal interpretación, es muy común tratar estas cuestiones por separado, y así es como se discutirá en estas páginas, en primer lugar, poniendo en escena los problemas relacionados con las estrategias interpretativas dominantes y, más adelante, debatiendo la cuestión de la autoridad sobre la interpretación constitucional.This article deals with constitutional interpretation by discussing the meaning of the Constitution and who should be responsible for its interpretation. Although some believe the ideal constitutional interpretation is the one resulting from a collective process, which covers the institutional issue of who would have the authority to make such an interpretation, it is very common to treat such matters separately, and this is how the matter will be discussed in these pages – first, bringing to scene the problems related to the dominant interpretive strategies and, further on, discussing the issue of authority for constitutional interpretation.
