The conclusion of executive agreements is an established practice in the international community. This type of agreements, whose process of celebration is carried out exclusively by the Executive Branch, without congress interventions, recognizes a customary origin, being traditionally present in the history of the foreign policy of the States. Due to the relevance and wide diffusion of this practice, executive agreements were contemplated by the Vienna Convention on the Law of Treaties; however, its incorporation was not without discussion and controversy. Precisely, taking this into account, in this article we try to characterize and reflect on some central aspects of the theorical and technical discussion, developed during the Vienna Conference, which accompanied the insertion of executive agreements in the Convention on the Law of Treaties adopted in that conference.
