This article analyzes the Technical and Professional Education Law 26058/05 as a legal instrument that formalizes the right to compulsory secondary education and the effects that results on the full exercise of the right to educate students in the technical and professional orientation. The results of a fieldwork carried out in a technical school in the city of Córdoba (Argentina) are recovered in the framework of an ongoing research (to get a PhD) of a qualitative nature. The theoretical developments of Stephen Ball are recovered on the Policy Cycle (Policy Cicle Approach), focusing the analysis in the context of the practice that is where the policies are enacted. The analysis is complemented with the introduction of the term "inclusive exclusion dynamics" developed by Pablo Gentili, which allows us a multidimensional approach to the factors that operate in the application of the Professional Technical Education Law. As a working hypothesis, it is argued that Law No. 26058/05 was characterized by significant changes at the level of the legislation and minor advances in terms of concrete actions to guarantee their effectiveness. As result it was possible to demonstrate that the socio-economic origin of the students, together with the absence of a genuine transformation of the formative proposal of the technical school, have come together in the development of dynamics of educational exclusion of the population under study.
