The article analyzes a kind of judicial litigation which has been carried on for more than ten years: the one that seeks for the entrance and permanence in the emergency housing subsidy program from the Buenos Aires City Government. More than three thousand individual claims were initiated by the public defense in order to protect the population experiencing a situation of poverty. Those cases turned into the greater social claim in the local courts, showing a high level of democratization with regard to the access to justice. During the process institutional and practical circuits between the executive authority and the judicial power were settled. The courts consolidated as “the other window” of provision of a housing subsidy for those social sectors. As of 2012 the local legislative branch introduced selectivity criteria according to the population’s situation of vulnerability which excluded large groups of people from the legal resource (“tap closing”). Nevertheless, the substantive aspects of the relation between State branches, the significance of the “right to housing” and the programmatic answer to the housing crisis were not modified.
