This article characterizes the situation of Argentina in the provision of water and sanitation and the advances in the recognition of access to them as a human right. This article argues that the national jurisprudential development and a selection of other constitutions in Latin America, have recognized this human right prior to the issuance of United Nations Resolution in 2010. First, it presents the main aspects of international recognition of the human right to water and sanitation; then focuses on the Argentine case characterizing the historical evolution of services and modalities assuming the regulatory and institutional framework; and, after, it describes the jurisprudential developments regarding the recognition of this human right.
