Tesis doctorales en jurisprudencia y saber penitenciario en la Universidad de Buenos Aires (1869-1915): Revisitando una fuente de historia social de la justicia y el derecho

Abstract

Entre las diversas fuentes que habitualmente se emplean para retratar el pensamiento jurídico nacional entre mediados del siglo XIX y comienzos del XX, las tesis doctorales para optar al grado de doctor en jurisprudencia ocupan un lugar relativamente significativo. Durante el primer siglo de vida de la Universidad de Buenos Aires se defendieron unas 3.450 tesis doctorales en jurisprudencia. A lo largo de ese tiempo las características de las tesis así como los temas que trataron experimentaron mutaciones que permiten al investigador rastrear distintas cuestiones vinculadas no sólo a la evolución y al cambio en cuestiones de derecho sino de la manera en que se concebía su práctica. En este artículo nos proponemos, en primer lugar, reflexionar sobre las tesis como fuente para la historia del derecho, considerando especialmente su contexto de producción. En segundo lugar analizaremos su uso específico para el estudio de la reforma penitenciaria, que comienza a ser estudiada como tema de tesis en 1869, cobrando importancia hacia los primeros años del siglo XX y finalmente cayendo en desuso como tal hacia 1915.

Among the various sources that are often used to portray the national legal thought from the mid-nineteenth and early twentieth centuries, the thesis for the degree of "Doctor en Jurisprudencia" take a significant place. During the first century of the University of Buenos Aires 3,450 theses were defended. Throughout that time their characteristics, as well as the topics discussed within them, experienced mutations that allows the researcher to track down various issues related not only to the evolution and change in matters of law but the way the practice was conceived. In this article we propose to reflect on the thesis as a source for legal history, especially considering its context of production. Secondly, it will be analyzed their specific use for the study of prison reform, which begins to be studied as a thesis topic in 1869, gaining importance to the early twentieth century and finally falling into disuse in 1915.
