La literatura en el proceso de investigación y enseñanza del derecho

Abstract

El objetivo de este artículo es determinar los usos que la literatura ha tenido tanto dentro del proceso de producción de conocimiento científico en el campo jurídico como en el de enseñanza del derecho. En el primero de dichos procesos, se explorará el papel que juega la narrativa en el contexto de descubrimiento y las barreras que se le imponen cuando se propone circular más allá de ese contexto. En particular, se relevarán las estrategias puestas en juego en la comunidad jurídica para generar y reproducir este encierro de la literatura en la primera fase de un diseño de investigación estandarizado. En el proceso de enseñanza, se procurará determinar las potencialidades y límites de la literatura como “recurso didáctico” y “ejemplificación”, con la pretensión nuevamente de mostrar las estrategias con las que se procura producir y reproducir una escisión entre la narrativa literaria y las teorías científicas, que protocolizan, dan cuenta, argumentan y prueban aquello que la literatura sólo puede susurrar.

The objective of this work is to determine the function that Literature has had in the process of scientific knowledge production in the judicial area as well as in the teaching of Law. In the first one, it will be explored, the place of the narrative in the context of discovery and the limits that it is imposed with in order not to trespassthis context. Particularly, it will be exposed the strategies which are displayed into the judicial community to generate and reproduce this confinement of Literature into a standard investigation design.In regard to the teaching process, it will be established the potentialities and limits of Literature as a didactic resource and exemplification, with the intention to show the strategies with which it will be produced and reproduced an excision between the narrative literature and the scientific theorieswhich prove what literature only can whisper.
