Legal determinacy and certainty are, to some extent, fundamental elements of the Rule of Law. However, there is a gap between the normative ideals of the Rule of Law and its effective implementation in our legal systems. In this paper, we only analyze some aspects of legal determinacy and, particularly, focus on the so-called ‘void for vagueness’ principle. We show that this principle reflects certain ideas on legislation, personal autonomy and criminal that do not correspond to contemporary views about the functioning of legal rules, the nature of language and the justification of judicial decisions in applying criminal law. We conclude that the void for vagueness principle allows us to live with the illusion that we are protected by a fundamental right incorporated in the Rule of Law.
