Historias y porvenires para repensar sujetos de derechos y otros

Abstract

En este texto dialogo con los comentarios recibidos de parte de dos colegas que aceptaron reflexionar a partir de mis planteos en torno a nuevos sujetos y nuevos otros en el derecho contemporáneo. Por un lado, Leandro Drivet que en su artículo titulado ¨Desmontar el abismo entre Sujeto y Naturaleza. Sobre el extravío desnaturalizante de la subjetividad¨ efectúa una revisión de los presupuestos subyacentes al concepto de sujeto que informa el derecho moderno. Por el otro lado, el trabajo de Natália de Souza Lisboa denominado ¨Seguir soñando, sin dejar de ver lo obvio: otros y nuevos sujetos y personas desde la perspectiva latinoamericana¨ que se enfoca en la necesidad de crear y ampliar futuros posibles mediante el reconocimiento de nuevos y otros sujetos y personas desde el prisma del denominado nuevo constitucionalismo latinoamericano.

This paper discusses the comments received from two colleagues who agreed to reflect on the article in which I put forward some ideas on new subjects and new others in contemporary law. On the one hand, Leandro Drivet who in his article entitled “ Dismantle the abyss between Subject and Nature. On the denaturing misdirection of subjectivity” reviews the assumptions underlying the concept of the subject that informs modern law. On the other hand, the article by Natália de Souza Lisbôa entitled “Keep dreaming while seeing the obvious: others and new subjects and people from the Latin American perspective” focuses on the need to create and expand possible futures through the recognition of new and other subjects and persons from the prism of the so-called new Latin American constitutionalism.
